At least this is so when defendant “also … allegedly directed viewers of her post to click on her ‘Likes’ page where the video had been archived” (not clear what the judge would have thought if the case involved solely the “like”).
Under Section 836.13, Florida Statutes, a plaintiff may bring a civil action against anyone who “willfully and maliciously promotes” an “altered sexual depiction” of her without her consent. The statute defines “promote” broadly, covering actions like publishing, distributing, exhibiting, or presenting the altered content.

By “liking” an X.com post that featured the deepfake video, the video was exhibited on Defendant’s X.com account’s “Likes” page, “which tracked and displayed ‘liked’ posts for other users to see.” Defendant also brought the video “before the public” when she allegedly directed viewers of her post to click on her “Likes” page where the video had been archived. (See Am. Compl. ¶ 45 (“Defendant intended for this statement [(‘Go to my likes.’)] to encourage her followers and other members of the public to watch the [d]eepfake [v]ideo, which had been added to her ‘Likes’ page around the same time.” (alterations added and adopted))).
Because Plaintiff plausibly alleges Defendant promoted the deepfake video under section 836.13, dismissal is unwarranted.
Staying off social media seems the best way to avoid these problems.But at least put your settings to private and never “LIKE” any video. Liking a video doesn’t help you so why do it. I use YouTube for the news and other information, but I don’t share my watch list or any other info with anyone. Always keep your settings to “Private”. You can even delete your watch history once and a while too. But don’t be watching things you wouldn’t want everyone to know about.

They MAKE things like Sextortion work! Without them, the threat of exposure the sextortionists use would be meaningless! Without them shaming, and potentially arresting teens for making and/or asking for a selfie… this scam would not work… or at least not as well as it does.
Also, we now live in a 24×7 Global world, where absolutely anyone can get in contact with absolutely anyone else, 24x7x365… for any purpose. K&D keep giving various people throughout the world more and more reasons to contact potential victims, and more and more ways to make their scams work!
Some of the K&D Collective have to be smart enough to know they are making things worse, so I have to assume they just don’t care! They are going to demand that all obey or else, and whatever happens, happens. Perhaps they presume that only SINNERS can be gotten to by this, so that makes it OK?
All they have to do is make it look like someone has Sinned against the demands of the K&D Collective.
Of course certain people will always be above suspicion! No matter how guilty they may appear to be, the collective is certain they could never be! No matter how much “Evidence” there may be, it will only prove that they are innocent victims of some evil conspiracy!
Sometimes these poor, completely innocent victims get elected to high office… despite being targeted for “frame ups” by evil conspiracies that try to make them look guilty! Sometimes President… sometimes Governor of Florida… who knows! K&D are certain they can tell the difference between an actual guilty Sinner, and a poor, innocent victim of a frame up!
K&D, a dream come true for every kind of extortionist there is…both foreign and domestic.
